Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the SMS messaging services, software platform, websites, and related services (collectively, the “Service”) provided by Lumius LLC, doing business as Demand8 (“Company,” “Demand8,” “we,” “us,” or “our”).

By accessing or using the Service, including sending or receiving SMS messages, you agree to be bound by these Terms.


SMS Disclosure & Consent

By opting in to Demand8’s SMS services, you expressly consent to receive automated and non-automated text messages related to:

Service notifications

Account updates and authentication (including 2FA)

Support communications

Marketing or promotional messages

Message frequency may vary. Message and data rates may apply depending on your mobile carrier.

Opt-Out

You may opt out of SMS communications at any time by replying STOP to any message. You may receive a final confirmation message.

Messaging Consent Requirements

You represent and warrant that you have obtained all legally required consents before receiving messages from Demand8 or using the Service to send messages to others.

Consent may be collected through website forms, written agreements, verbal authorization, or other lawful means consistent with applicable laws.

You acknowledge that you—not Demand8—are responsible for ensuring compliance with all SMS, voice, and messaging laws, including but not limited to the Telephone Consumer Protection Act (TCPA).


Message Types & Delivery

Messages may include alerts, reminders, updates, promotional offers, and other service-related communications.

Demand8 does not guarantee message delivery, timing, or receipt. Delays or failures may occur due to carrier issues, network conditions, or device compatibility.


User Obligations & Acceptable Use

You agree not to use the Service to send or facilitate messages that are:

Illegal, deceptive, or misleading

Harassing, abusive, or threatening

Obscene or offensive

In violation of privacy or consumer protection laws

You agree to comply with all applicable local, state, federal, and international laws governing electronic communications.


Subscription Plans & Billing

Demand8 offers the following subscription plans:

$297/month

Includes:

Fully built website

Access to the Demand8 platform (web & mobile)

Business phone number (texting & calling)

CRM access

Automations

Remarketing tools

Customer review tools

$750/month

Includes all features of the $297 plan, plus:

Full management and optimization of Google Local Service Ads

Subscriptions are offered on a month-to-month basis or a prepaid three-month commitment, which includes a complimentary Google My Business optimization (valued at $400).


Advance Payment & Auto-Renewal

All subscription fees are billed in advance and automatically renew unless canceled. Payments are processed via secure third-party payment processors (e.g., Stripe).


Usage-Based Charges (Rebillable Costs)

Certain services incur usage-based fees, including but not limited to phone numbers, SMS/MMS, voice calls, and number intelligence services.

Example rates (subject to change):

Phone Numbers:

Local: $1.15/month

Toll-Free: $2.15/month

SMS (US/Canada): $0.0079 per segment (inbound/outbound)

MMS (US/Canada): $0.02 outbound | $0.01–$0.02 inbound

Voice Calls: $0.0180/min outbound | $0.0085–$0.0220/min inbound

Number Intelligence: $0.005–$0.01 per function

Clients maintain a digital wallet for usage-based charges. When funds fall below required thresholds, accounts may be automatically replenished based on selected settings.


No Refund Policy

All payments to Demand8 are final and non-refundable, including subscription fees, setup fees, and usage-based charges.

You acknowledge that Demand8 services are custom-built and immediately initiated, making refunds impractical once service delivery begins.


Chargebacks & Disputes

You agree not to initiate chargebacks or payment disputes for services rendered under these Terms.

Unauthorized or fraudulent chargebacks constitute a material breach of this agreement. Demand8 reserves the right to submit evidence of contract acceptance, service delivery, and platform usage, and to seek recovery of all associated fees, costs, and damages.


Cancellation

You may cancel your subscription at any time. Cancellations take effect at the end of the current billing cycle. No refunds are issued for unused time or prepaid terms.


Service Fulfillment

Services are considered delivered and fulfilled once:

The client website is completed and made available, and

Platform access and automation setup are finalized

Optional onboarding or training assistance does not delay fulfillment.


Trials, Promotions & Discounts

Free trials or promotional offers may be provided at Demand8’s discretion. Limited setup may occur during trial periods. Full services commence once billing begins. Promotional discounts do not alter these Terms.


Payment Failures & Suspension

If payment fails, Demand8 may attempt to collect payment multiple times over a reasonable period. Accounts may be suspended if payment is not received within 48 hours of the initial failure. Service will resume upon payment.


Changes to These Terms

Demand8 reserves the right to modify these Terms at any time. Updates will be posted on our website or communicated directly when feasible. Continued use of the Service constitutes acceptance of the updated Terms.
